Idaho Code requires that claims for medical malpractice go through a Prelitigation screening process. To file a claim for medical malpractice, please submit the form below. This form may be downloaded, filled out, and emailed, mailed or hand-delivered to the Idaho State Board of Medicine (Board).

Please read carefully the instructions on the Application and Claim Form for Medical Malpractice Prelitigation Screening Request. To process your request, please submit the Medical Malpractice Prelitigation Claim Form to the Board of Medicine. Named Respondents (Idaho Licensed Physicians and/or Acute Care General Hospitals) will receive a copy of the filed Prelitigation Screening Request from the Board. Claimant will also need to send a copy of the Application and Claim Form to the named Respondents. NOTE: Incomplete applications will delay the process.

Prelitigation Screening

Applications

Hearings may be requested by submitting the Application and Claim Form provided by the Board (see above). Claims must set forth in reasonable detail including when, where, and how the health care in question is alleged to have been negligently provided and the damages claimed.

Panel Chairmen

The panel chairmen are attorneys appointed by the Idaho State Bar.

Hearings

The panel chairman schedules and conducts hearings. It is important that panelists and persons involved appear at the time and place hearings are scheduled. Failure to appear can cause inconvenience and substantial loss in time and expense for many people. It is the responsibility of the parties to arrange their own representation. Any Claimant or Respondent who does not intend or wish to appear or be represented at the hearing is requested to notify the Panel Chairman immediately. The law does not require the claimant to be represented by an attorney.

Board of Medicine

The Board of Medicine receives requests for hearings, makes appropriate notifications, appoints the panel, and assists the panel chairmen as requested in making the necessary arrangements for hearings.

BOARD OF ATHLETIC TRAINERS

The Board of Athletic Trainers is an advisory body to the State Board of Medicine. The Board of Athletic Trainers is responsible to administer, coordinate, and enforce Idaho law concerning athletic trainers. They evaluate the qualifications and fitness of applicants, and approve the applications for licensure. They may issue subpoenas, examine witnesses, and administer oaths, and may investigate practices which are alleged to violate the provisions of the athletic trainer law. The Board of Athletic Trainers evaluates all applicants for qualification and fitness for licensure, and makes recommendations to the Board of Medicine concerning the issuance and revocation of licenses. They also recommend rules to be promulgated concerning athletic training.

COMMITTEE ON PROFESSIONAL DISCIPLINE (COPD)

The Board of Medicine appoints members of the COPD, which shall have the authority under the direct supervision and control of the board to conduct professional disciplinary enforcement investigations. COPD recommends appropriate action to the board with respect thereto. The COPD has no authority to impose sanctions, limitations, or conditions on licenses issued and is authorized only to make recommendations to the board with respect to that.

DIETETIC LICENSURE BOARD

The Dietetic Licensure Board is an advisory body to the State Board of Medicine. The Dietetic Licensure Board is responsible for making recommendations to the Board of Medicine concerning the qualification of applicants for licensure, as well as the issuance and revocation of licenses. They also recommend rules to be promulgated concerning dietetic practice.

NATUROPATHIC MEDICAL BOARD

The Naturopathic Medical Board is an advisory body to the Idaho Board of Medicine. The Naturopathic Medical Board is responsible for making recommendations to the Board of Medicine concerning the qualification of applicants for licensure of naturopathic medical doctors, along with regulation of existing licensees through application of the statute and rules pertaining to the practice of naturopathic medicine.

PHYSICIAN ASSISTANT ADVISORY COMMITTEE

The Physician Assistant Advisory Committee was created and made a part of the Idaho State Board of Medicine by resolution. Members of the Committee are appointed by the Board in accordance with the rules.  Though the Committee has no authority to revoke licenses or impose limitations or conditions on licenses, they make recommendations to the Board, regarding Physician Assistant licensure.

RESPIRATORY CARE LICENSURE BOARD

The Respiratory Care Licensure Board is an advisory body to the State Board of Medicine. The Respiratory Care Licensure Board is responsible to review all applications for the licensure and temporary permits of respiratory therapists and polysomnographers and make recommendations to the Board of Medicine concerning the issuance and revocation of licenses and temporary permits. They also recommend rules to be promulgated concerning respiratory practice.

This newsletter is the only information newsletter published by the Idaho Board of Medicine and serves as the Board’s notification of rule changes, policy information, and disciplinary information provided to all licensees of the Idaho Board of Medicine.

Q: What question does the Board of Medicine ask about mental health when getting licensed?

A: Idaho Board of Medicine is committed to the “ALL IN” campaign, reducing mental health stigma for physicians.  The Board has revised the question physicians have previously been required to answer to get licensed.  The question now asks, “Are you currently suffering from any condition for which you are not being appropriately treated that impairs your judgment or that would otherwise adversely affect your ability to practice your medical profession with reasonable skill and safety?”  The hope is if a need should arise for a physician to seek mental health, addiction, or substance use treatment, there will not be a fear of losing their license and getting the help they need.

Please be advised the Division of Occupational and Professional Licenses (DOPL) offers a confidential, non-disciplinary program. The Health Professional Recovery Program aims to assist health professionals and their families in identifying substance use disorders that may be a potential threat to the individual or their loved ones. The program aims to lessen the negative impacts on individuals and their careers. Licensees can choose their direction and get help addressing substance use or mental health without stigma.

Q: How can I verify when my license has been issued? 

A: You will receive a licensure packet in the mail, including your license cards and a decorative wall certificate. Licensure status may also be verified by clicking on the link entitled  License and Registration Search.

Q:  I have let my license lapse, what must I do to activate that license?

A:  A license that has been lapsed less than five years may be reinstated upon submission of a renewal application together with the payment of all back renewal fees, a license re-instatement fee, and proof of completion of continuing education as required in the rules.  If a license has been lapsed for more than five years, a new application for licensure is required.

Q: How do I request a duplicate license?

A: The license/registration issued to you by the Division is public proof that you are entitled to pursue certain activities regulated by Idaho Law.  If your license/registration becomes lost or destroyed, you may obtain a replacement from the Division.  A replacement may also be requested if you have changed your name or address and wish to receive a license/registration bearing the updated information.  

You may complete the Application for Duplicate License form online, print it out and sign it, and send it with the fee required by Idaho law to the Division.  Your application will not be processed unless the fee is received with the application.   A replacement card will be sent to the mailing address.

Q: How do I request an official verification of my license in Idaho?

A: Certifications can be obtained two ways from Idaho:

  1. Free primary source verification of license/registration status may be obtained via the web at www.dopl.idaho.gov. Click on search licenses and registrations. These certifications contain all public information.
  2. Purchase an official license verification for $20.00 using a Visa/MasterCard credit card. Official verifications are mailed within 1-3 business days. Use the Request for Official Licensure Certification Form

PLEASE NOTE: Physicians and physician assistants may obtain primary source license verifications online through VeriDoc.

Medical Student registration granted prior to July 1, 2011 cannot be verified online, at this time. A list can be emailed upon request.

Q: What are the requirements for continuing education?

A: The purpose of practice relevant CME is to enhance competence, performance, understanding of current standards of care, and patient outcomes. Each person licensed to practice medicine and surgery or osteopathic medicine or surgery in Idaho is required to complete no less than 40 hours of practice relevant, Category 1, CME every two (2) years.

All education offered by institutions or organizations accredited by the ACCME and reciprocating organizations or the AOA are considered approved. Licensees must, at license renewal, provide a signed statement to the Board indicating compliance. The Board may conduct CME audits to verify compliance.

The Board may accept certification or recertification by a member of the American Board of Medical Specialties, the American Osteopathic Association Bureau of Professional Education, or the Royal College of Physicians and Surgeons of Canada in lieu of compliance with continuing education requirements during the cycle in which the certification or recertification is granted. The Board may also grant an exemption for full time participation in a residency or fellowship training at a professionally accredited institution.

The Board may condition, limit, suspend, or refuse to renew the license of any person whom the Board determines has failed to comply with the continuing education requirements.
